1. Introduction
Welcome to Clawmmerce ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Clawmmerce platform, including our website, APIs, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Clawmmerce provides a platform that enables AI agents to manage cryptocurrency wallets on behalf of users, with user-defined spending limits and trading strategies. Please read these Terms carefully before using our Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent and warrant that you meet these requirements and that you are not prohibited from using the Service under any applicable laws in your jurisdiction.
3. Account & Wallet Security
Clawmmerce uses passkey-based authentication powered by Turnkey for wallet security. You are solely responsible for:
- Maintaining the security of your passkeys and authentication devices
- All activities that occur under your account or wallet
- Backing up your wallet recovery information as recommended
- Configuring appropriate spending limits for your AI agents
We do not have access to your private keys. If you lose access to your passkey or authentication device, you may permanently lose access to your wallet and any funds within it.
4. AI Agent Trading & Strategies
The Service allows you to create "strategies" that authorize AI agents (via MCP protocol integration with tools like Claude Desktop) to execute cryptocurrency transactions on your behalf. You acknowledge and agree that:
- You are solely responsible for configuring and monitoring your trading strategies
- AI agents will execute trades automatically based on your configured parameters
- Spending limits you set are the only restriction on agent activity—choose them carefully
- You understand the risks of automated trading, including rapid execution without human review
- Strategy execution depends on external factors including network conditions, liquidity, and API availability
5. Risk Disclaimers
5.1 Not Financial Advice
The Service does not provide financial, investment, tax, or legal advice. All trading decisions, whether executed manually or through AI agents, are made at your sole discretion and risk. You should consult with qualified professionals before making any financial decisions.
5.2 No Guarantee of Profits
We make no guarantees regarding trading performance, profits, or returns. Cryptocurrency markets are highly volatile. Past performance does not indicate future results. You may lose some or all of the funds you deposit.
5.3 Risk of Loss
Trading cryptocurrencies involves substantial risk of loss. You should only trade with funds you can afford to lose. Risks include but are not limited to:
- Market volatility and rapid price changes
- Smart contract vulnerabilities and exploits
- Blockchain network failures or congestion
- Regulatory changes affecting cryptocurrency trading
- Loss of funds due to AI agent behavior, bugs, or misconfiguration
- Liquidity risks and slippage
5.4 Beta Software
Clawmmerce is currently in beta. The Service may contain bugs, errors, or vulnerabilities. Features may change, break, or be discontinued without notice. We strongly recommend starting with small amounts on testnet (Base Sepolia) before using mainnet (Base).
6. User Responsibilities
You agree to:
- Use the Service only for lawful purposes and in compliance with all applicable laws
- Take full responsibility for all trades executed through your account, whether manual or automated
- Monitor your AI agents and strategies regularly
- Report any bugs, security issues, or unauthorized access immediately
- Not use the Service for money laundering, fraud, or other illegal activities
- Comply with all applicable tax obligations arising from your cryptocurrency transactions
7. Supported Networks
Clawmmerce currently supports the following networks:
- Base Mainnet — Live trading with real funds
- Base Sepolia (Testnet) — Testing with no real value
We may add or remove network support at our discretion. Sending funds to unsupported networks may result in permanent loss.
8. Third-Party Services
The Service integrates with third-party services including:
- Turnkey — Secure wallet infrastructure and key management
- Alchemy — Blockchain RPC and data services
- MCP-compatible AI tools — Claude Desktop and other AI assistants
- Decentralized exchanges — For executing swaps and trades
We are not responsible for the availability, security, or performance of third-party services. Their use is subject to their respective terms and privacy policies.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWMMERCE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR FUNDS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Modifications to Terms
We may modify these Terms at any time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, you should withdraw any funds from your wallet. We are not responsible for funds that remain in wallets after account termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of England and Wales.
